Welcome to Lions Creek Retail & Club. Throughout these Terms, the terms “we”, “us”, and “our” refer to Lions Creek Retail & Club. We operate this website and online store, including all related information, content, features, tools, products, and services made available through lionscreek.ca (the “Services”).

These Terms of Service (“Terms”) govern your access to and use of our Services, including browsing our website and purchasing products from our store.

By visiting, using, or purchasing from our Services, you agree to be bound by these Terms and by our related policies, including our Privacy Policy, Shipping Policy, and Returns & Refund Policy. If you do not agree, you should not use our Services.

1. Eligibility and Use of Our Store

By using our Services, you confirm that you are at least the age of majority in your province, state, or territory of residence, or that you are using the Services with the consent of a parent or legal guardian.

You agree to use our Services only for lawful purposes and in accordance with these Terms.

You may be asked to provide account, billing, payment, and shipping information. You represent and warrant that all information you provide is accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2. Products

Lions Creek sells premium food and gourmet products, including but not limited to Extra Virgin Olive Oils, balsamic vinegars, olives, and related items.

We make every effort to display product descriptions, images, colors, and packaging as accurately as possible. However:

  • Product appearance may vary depending on your device or screen settings.
  • Packaging, labels, and presentation may change from time to time.
  • Natural food products may vary slightly by batch, harvest, or production run.

All product descriptions, pricing, and availability are subject to change without notice.

We reserve the right to discontinue products at any time and to limit quantities sold to any customer, region, or order.

3. Food Products and Intended Use

Our products are intended for normal household and culinary use unless otherwise stated.

You are responsible for reviewing product ingredients and suitability for your personal dietary needs, allergies, or sensitivities. Lions Creek does not provide medical or nutritional advice through this website, and nothing on this website should be interpreted as medical advice.

If you have questions about ingredients, allergens, or storage, please contact us before purchase.

4. Orders

When you place an order, you are making an offer to purchase products from us.

We reserve the right to accept, refuse, limit, or cancel any order at our discretion, including in cases involving:

  • product unavailability,
  • pricing or listing errors,
  • suspected fraud,
  • payment issues,
  • unusual or excessive order quantities,
  • or orders that appear intended for resale or export without approval.

Your order is not accepted until payment has been authorized and we have confirmed the order.

If we need to cancel or change an order after it is placed, we will attempt to contact you using the email address or phone number provided at checkout.

5. Pricing and Billing

All prices are listed in Canadian dollars (CAD) unless otherwise stated.

Prices, promotions, discounts, and availability are subject to change without notice. The price charged will be the price displayed at the time your order is placed, subject to correction for obvious errors.

Unless otherwise stated, prices do not include:

  • applicable sales taxes,
  • shipping charges,
  • customs, duties, or import fees (if any).

You agree to provide valid and current payment information and authorize us to charge your selected payment method for the full amount of your order, including shipping and applicable taxes.

6. Shipping and Delivery

Shipping is subject to our separate Shipping Policy.

Delivery dates and transit times are estimates only and are not guaranteed. We are not responsible for shipping delays caused by carriers, weather, customs, strikes, or events outside our reasonable control.

Unless otherwise required by applicable law, title and risk of loss pass to you when your order is transferred to the carrier.

Please review your order carefully and inspect shipments promptly on arrival.

7. Returns, Refunds, and Damaged Items

Returns and refunds are subject to our separate Returns & Refund Policy.

Because many of our products are food items, opened or partially consumed products are generally not returnable unless there is a verified issue involving damage, defect, or fulfillment error.

If your order arrives damaged, leaking, defective, or incorrect, please contact us promptly at sales@lionscreek.ca with your order number and supporting photos.

8. Promotions and Future Programs

From time to time, we may offer promotions, discounts, subscriptions, memberships, or other special programs.

Any such offers may be subject to separate terms in addition to these Terms. If there is a conflict between these Terms and the specific terms of a promotion or program, the specific promotion or program terms will govern.

At this time, no points-based loyalty program forms part of these Terms unless and until separate loyalty or rewards terms are published.

9. Intellectual Property

All content on this website, including text, graphics, logos, product descriptions, images, page layouts, and branding, is the property of Lions Creek Retail & Club or its licensors and is protected by applicable intellectual property laws.

You may use our Services for your personal, non-commercial use only. You may not copy, reproduce, republish, sell, distribute, modify, or exploit any part of the Services without our prior written consent.

“Lions Creek,” related logos, and associated branding are proprietary to us or used under license.

10. Third-Party Services and Links

Our Services may contain links to third-party websites, tools, apps, or services. We are not responsible for examining or evaluating their content, terms, accuracy, or practices.

Your use of third-party websites or services is at your own risk and subject to the terms and policies of those third parties.

11. Shopify Platform

Our store is hosted on Shopify, which enables us to provide the ecommerce platform for our Services. However, all purchases made through this website are made directly from Lions Creek Retail & Club, not from Shopify.

To the extent permitted by law, Shopify is not responsible for any aspect of the sale, fulfillment, return, or quality of products purchased from us.

12. User Comments, Reviews, and Feedback

If you submit reviews, comments, feedback, suggestions, or other content to us, you grant us a non-exclusive, royalty-free, worldwide, perpetual right to use, reproduce, edit, publish, and display that content for business purposes, including marketing and promotional purposes.

You agree that your submissions will not be unlawful, abusive, misleading, defamatory, infringing, or otherwise objectionable.

We reserve the right, but not the obligation, to remove or edit content submitted by users.

13. Accuracy, Errors, and Omissions

Occasionally there may be information on our website that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping, or availability.

We reserve the right to correct any such errors, inaccuracies, or omissions, and to update information or cancel orders if necessary, without prior notice.

14. Prohibited Uses

You may not use our Services:

  • for any unlawful purpose,
  • to violate any law or regulation,
  • to infringe intellectual property rights,
  • to submit false or misleading information,
  • to transmit malicious code or interfere with website functionality,
  • to scrape, crawl, or harvest data,
  • to spam, phish, or otherwise abuse the Services,
  • or to attempt unauthorized access to our systems or customer information.

We reserve the right to suspend or terminate access if we believe you have violated these Terms.

15. Disclaimer of Warranties

Except as expressly stated by Lions Creek Retail & Club, the Services and all products are provided on an “as is” and “as available” basis, without any representation, warranty, or condition of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

We do not guarantee that the Services will be uninterrupted, secure, timely, or error-free.

Some jurisdictions do not allow limitations on implied warranties, so parts of this section may not apply to you.

16. Limitation of Liability

To the fullest extent permitted by law, Lions Creek Retail & Club and its owners, directors, officers, employees, contractors, service providers, and affiliates shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or related to:

  • your use of the Services,
  • your inability to use the Services,
  • any product purchased through the Services,
  • delays, data loss, interruptions, or technical failures,
  • or errors or omissions in website content.

Our total liability in respect of any claim relating to a purchase will not exceed the amount paid by you for the product or order giving rise to the claim, except where prohibited by law.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

17. Indemnity

You agree to indemnify, defend, and hold harmless Lions Creek Retail & Club and its affiliates, service providers, and partners from any claim, demand, loss, liability, damage, or expense arising out of:

  • your breach of these Terms,
  • your misuse of the Services,
  • or your violation of any law or rights of a third party.

18. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be severed and the remainder of the Terms shall continue in full force and effect.

19. Waiver and Entire Agreement

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with any policies posted on this website, constitute the entire agreement between you and us regarding your use of the Services and supersede prior communications or agreements relating to the same subject matter.

20. Governing Law

These Terms and any dispute arising out of or relating to them or your use of the Services shall be governed by the laws of the Province of Saskatchewan and the applicable laws of Canada, without regard to conflict of law principles.

You agree that the courts of Saskatchewan shall have exclusive jurisdiction over any dispute arising from or relating to these Terms or the Services, unless applicable law requires otherwise.

21. Changes to These Terms

We may update these Terms from time to time by posting the revised version on this page.

Any changes will apply to future use of the Services from the date they are posted. Your continued use of the Services after changes are posted constitutes acceptance of those changes.

Lions Creek Rewards – Terms & Conditions

Lions Creek Rewards (“Program”) is offered by Lions Creek and is available for eligible retail customers shopping online through Shopify and in-store through Lions Creek Retail. By enrolling in or using the Program, you agree to these Terms & Conditions.

1. Eligibility

The Program is open to individuals who provide a valid email address or phone number for account identification. Lions Creek may refuse, suspend, or terminate membership at its discretion where misuse, fraud, or system abuse is suspected.

2. Earning Points

Members earn:

  • 1 point per $1 CAD of eligible spend, calculated on the post-discount, pre-tax subtotal.

Points are not earned on:

  • Gift card purchases (unless stated otherwise during promotional periods),
  • Taxes,
  • Shipping (unless stated otherwise during promotional periods),
  • Any items or transactions explicitly excluded by Lions Creek from time to time.

Points may be adjusted for returns, refunds, order cancellations, or pricing corrections.

3. Redeeming Points

Points may be redeemed for discounts as presented at checkout or in-store. A standard redemption option is:

  • 500 points = $10 off.

Redemption values, thresholds, and eligible items may change without notice.

4. Bottle Equivalents (Basket Booster qualification)

For Basket Booster calculations:

  • 250ml Lions Creek products = 1 Bottle Equivalent
  • 500ml Lions Creek products = 2 Bottle Equivalents

Only eligible Lions Creek retail SKUs count toward Bottle Equivalents. Additional sizes may be assigned equivalency values in the future.

5. Basket Booster (Single Transaction Requirement)

The Basket Booster is an instant discount and bonus-points benefit designed for multi-bottle purchases.

To qualify:

  • A member must purchase at least 6 Bottle Equivalents in a single transaction.

Bottle Equivalents do not carry over across multiple transactions.

6. Basket Booster Discount Values

When a qualifying transaction reaches the following thresholds, the Basket Booster discount is applied:

  • 6–11 Bottle Equivalents: $10.00 off
  • 12–17 Bottle Equivalents: $20.00 off
  • 18–23 Bottle Equivalents: $30.00 off
  • 24+ Bottle Equivalents: $40.00 off

These thresholds reflect a capped-value structure equivalent to 33% of one 250ml bottle per 6 equivalents, to ensure fairness across product sizes.

7. Basket Booster Bonus Points

When a transaction qualifies for the Basket Booster (6+ Bottle Equivalents in a single transaction), members receive:

  • +100 bonus points.

Bonus points are awarded once per qualifying transaction and do not increase at higher Bottle Equivalent thresholds (12, 18, 24).

8. Stacking and Promotions

Basket Booster discounts generally:

  • Do not combine with other order-level promotions or discount codes unless explicitly stated by Lions Creek.

Lions Creek may run limited-time events (e.g., double-points offers) with separate rules.

9. Returns and Adjustments

If qualifying items are returned:

  • Basket Booster discounts and/or points may be recalculated,
  • Points may be reversed or reduced accordingly.

10. Changes or Termination

Lions Creek may modify, suspend, or terminate the Program or any associated benefits at any time, including point-earning and redemption rates.

11. Privacy

Member information will be handled in accordance with Lions Creek’s privacy practices and applicable law.

12. Monetary Value

12.1 No cash value
Points, bonus points, rewards, tier benefits, and any other Program benefits (collectively “Rewards”) have no cash value, are not legal tender, and may not be exchanged for cash, credit, gift cards, or any other form of monetary payment, except as expressly provided when redeemed as a discount on eligible purchases under these Terms & Conditions.

12.2 Discount value only
Any reference to a monetary amount associated with Rewards (for example, “500 points = $10 off”) reflects only the maximum discount value available at the time of redemption on qualifying purchases, and does not mean that points themselves have an independent monetary value or constitute a debt or obligation owed by Lions Creek to the member.

12.3 Non-transferable
Rewards are personal to the member’s account, cannot be gifted, sold, transferred, assigned, or inherited (except where Lions Creek expressly permits this in writing), and may not be combined with Rewards from any other account.

12.4 No property or vested rights
Members do not own points or Rewards. All points and Rewards remain the sole property of Lions Creek until they are redeemed in accordance with these Terms & Conditions. Lions Creek may, in its sole discretion and subject to applicable law, adjust, revoke, limit, or cancel points or Rewards at any time, including in circumstances of suspected error, misuse, fraud, or system abuse.

12.5 Changes to point value or structure
Lions Creek reserves the right, at any time and without liability, to change the number of points required to earn or redeem any Reward, the manner in which points are earned or redeemed, and any associated discount values, subject to applicable law and any mandatory notice requirements.
